After leaving their jobs in Vietnam, many foreigners begin to learn about their right to receive a lump-sum social insurance payment. However, when it's time to process their application, their former company no longer responds to emails, the HR department has left, or the company has almost completely lost contact. This leads many to believe they cannot proceed with the procedure without confirmation from the company. In reality, this is a fairly common situation, especially for workers who have left their jobs some time ago or have already left Vietnam.

Many people mistakenly believe that only the company can work with the social insurance agency. In reality, the company is responsible for paying and declaring social insurance contributions while you are still employed, but the right to receive social insurance benefits belongs to the employee. According to the 2024 Social Insurance Law, the social insurance agency directly manages participation data and handles benefits for employees. This means that after the termination of your employment contract, you can proactively work with the social insurance agency to carry out procedures related to your rights.
Therefore, the fact that your former company doesn't respond does not mean you lose the right to withdraw social insurance benefits.
Foreign workers subject to mandatory social insurance participation may receive a lump-sum social insurance payment upon termination of their employment contract or expiration of their work permit if they do not continue working in Vietnam. It is crucial that the Social Security agency confirms that you have completed your legal employment in Vietnam and that your social security participation data has been fully recorded.
In normal circumstances, the company will assist employees in finalizing their social insurance records and completing related steps before leaving their job. However, if the company is uncooperative or no longer contactable, you will need to check the status of your data yourself.
The biggest problem is usually not the lack of contact with the company, but whether the social insurance data has been finalized. If the company has completed its declaration obligations and the data has been fully updated in the system, the process will be much simpler. Conversely, if there are still periods where the records are not finalized or the data is incomplete, the social insurance agency may need more time to verify before processing the application.
The answer is yes. In many practical situations, foreign workers still work directly with the Social Insurance agency to: check their social insurance contribution history, verify their social insurance number, request a replacement social insurance book if lost, or submit an application for a lump-sum social insurance benefit.
This is especially common in cases where the former company is no longer operating, is unresponsive, or the worker has returned to their home country. However, the Social Insurance agency will still rely on the previously declared company data to process benefits. Therefore, if information is missing or inconsistent, additional documents may be needed for verification.
Many people only discover the problem after returning to their home country. At that point, returning to Vietnam solely to handle social insurance issues is often impractical. In this case, employees can still complete the procedure through authorization. An authorized person in Vietnam can act on your behalf to work with the social insurance agency and process the documents according to regulations. However, the authorization document needs to be legally prepared. If signed abroad, the document usually needs to be notarized and legalized by the consulate before being used in Vietnam.
