You've worked for several companies in Vietnam, contributing to social insurance during different periods, but when preparing to withdraw your social insurance in a lump sum, you discover you're missing a social insurance book or data from one company. This is a very common situation, especially for foreigners or those who have changed jobs frequently. Many people worry whether missing a part of the record will affect their entire entitlement.

You can still withdraw your social insurance, but the missing data from one company may delay the processing. It's crucial to understand the legal aspects and how the social insurance agency handles data.

Each person has only one unique Social Insurance number

According to the 2014 Social Insurance Law, each employee has only one unique Social Insurance number, and the entire period of participation at different companies will be recorded and managed centrally on the Social Insurance agency's system. This means that, whether you work at 2, 3, or many companies, in principle, the periods of social insurance contributions will be added to the same record. The Social Insurance book is only a representation of that process, not the sole determining factor.

Therefore, the lack of a book from a company does not mean you lose the contributions from that company, but it may make verifying the entire period more complicated.

Can I withdraw my social insurance benefits if I don't have a company's social insurance book?

Yes, you can still withdraw your social insurance benefits in a lump sum, but the social insurance agency will need to verify your entire participation history before processing. If a company's data has been fully updated in the system, even if you no longer have the book, the social insurance agency can still process your application normally. However, if that period hasn't been finalized or there's missing information, your application may be temporarily suspended for verification.

This isn't a denial of benefits, but a necessary check to ensure payment is made correctly according to regulations. In some cases, the social insurance agency may request additional information or related documents to complete the data.

How to Handle Missing Social Insurance Booklets or Data

Instead of submitting your application immediately with incomplete information, a safer approach is to verify your entire social insurance participation history beforehand. You can work with the social insurance agency to check if the data for each company has been fully recorded.

If you discover missing information, you may need to supplement relevant documents such as employment contracts, termination notices, or other documents to prove your employment history. In many cases, requesting a reissue or data correction will help your application process more smoothly.

In reality, there are many reasons why a period of social insurance contributions may be incomplete. The company may not have completed the finalization procedures when you left, or you may have lost your social insurance booklet during a job change. There are also cases where the business has not fulfilled its social insurance contribution obligations, resulting in incomplete data updates in the system. In these situations, the social insurance agency will need time to verify and cross-check the information. This is why your application might be delayed, even though you are technically eligible.

When are you eligible to withdraw your social insurance contributions in a lump sum?

This is the most important condition determining whether you can withdraw your social insurance contributions, especially if you have worked for multiple companies but your data is incomplete.

According to Decree 143/2018/ND-CP, foreign workers are entitled to a lump-sum social insurance payment upon termination of their employment contract or expiration of their work permit without renewal. In other words, the core factor is not how many companies you worked for, but whether you have actually completed your legal employment in Vietnam.

However, in reality, the social insurance agency not only considers the condition of "having left the job," but also needs confirmation that your entire social insurance participation history has been fully recorded and finalized in the system. If you have worked for multiple companies but one of the periods is not clearly confirmed, your application may not be processed immediately, even if you meet all the legal requirements.

The absence of a company's social insurance book does not disqualify you from receiving a lump-sum social insurance payment, but it can complicate the process if the data is not fully verified. It's crucial to understand the legal requirements, review your entire social insurance participation history, and address any missing information before submitting your application to avoid delays or unnecessary procedures.
