Withdrawal of Social Insurance for foreigners is a legal right, but is the procedure too complicated once you have returned home? How can you avoid missing out on the funds accumulated after years of working in Vietnam?
Have you ever worried that the Social Insurance (SI) contributions you’ve made for years might "evaporate" simply because you didn't have time to complete the paperwork before flying home? Or perhaps you are already abroad, wondering how to claim this money without being physically present in Vietnam? Language barriers, constantly changing legal regulations, and cumbersome administrative processes often discourage many foreign workers. So, in reality, can foreigners authorize a lawyer to assist with the SI withdrawal? What is the optimal solution to protect your financial interests quickly and safely?

Many foreign employees face a major concern when their labor contract ends: "Can I get my SI money back?" The answer is YES, and Vietnamese law fully allows you to do this through an authorized representative, specifically reputable lawyers or law firms.
According to Decree 143/2018/ND-CP, foreign employees working in Vietnam who are subject to compulsory SI are entitled to a lump-sum SI payment when their labor contract terminates or their work permit expires without renewal. This acts as an "early retirement" fund, providing you with financial resources to resettle in your home country.
However, the biggest risk is not whether you are entitled to it, but the timing and method of implementation. Without a clear understanding of the process, your application may be rejected multiple times due to information errors, or worse, you might miss the submission deadline, leading to unnecessary legal complications. At DEDICA, we have seen many cases where clients tried to handle the paperwork themselves but got stuck at the SI book reconciliation stage or lacked valid documents proving the termination of the labor relationship.
Once you have left Vietnam, returning just to submit a few forms is a massive waste of time and money. At this point, the role of an experienced corporate lawyer becomes more important than ever. A lawyer not only works with the Social Insurance agency on your behalf but also helps review your entire contribution history, ensuring that your former employer has closed your SI book correctly and fully.
Using DEDICA’s services helps you eliminate language barrier concerns. We understand the inner workings of the Vietnamese legal system and know how to handle arising situations such as name discrepancies between passports and SI books, merging multiple SI books from different companies, or supporting payment reception via international bank accounts.

For the SI withdrawal process to go smoothly, employees need a clear roadmap. Early preparation, even before you officially quit, will significantly shorten the waiting time.
The prerequisite is that you must terminate your labor contract or have an expired work permit/practice certificate without renewal. A special point for foreigners is that you have the right to request a lump-sum SI payment immediately upon contract termination, instead of waiting 12 months like Vietnamese workers (except for specific cases).
The standard application file includes:
A small tip from DEDICA experts: Ensure that your personal information on the SI book matches your current passport 100%. A single typo in your name or date of birth can stall the process for months.
At DEDICA, we have built a professional process so that clients, regardless of where they are in the world, can closely monitor the progress. First, we conduct a review of your SI contribution status on the system. Next, our lawyers draft the POA and guide you through the signing and notarization procedures in the simplest way possible.
Once the full file is received, DEDICA will submit it and track the results at the local SI office. Once the benefit decision is issued, the money will be transferred directly to your bank account. We commit to absolute transparency and data privacy, protecting you from the risk of losing benefits or being exploited by untrustworthy services. If you are struggling to communicate with the HR department of your old company regarding the closing of your book, DEDICA can act as your "Outsourced Legal Department" to intervene and ensure the business fulfills its responsibilities.
1. I have been back home for over a year; can I still withdraw my SI?
Absolutely. The law does not set a maximum time limit to claim lump-sum SI after quitting. However, leaving it too long may lead to lost records. You should do it as soon as possible.
2. Can I receive my SI payment in USD or Euro?
The Vietnam Social Insurance agency will pay in Vietnam Dong (VND) via a bank in Vietnam. If you receive it into an international account, the bank will automatically convert it based on the exchange rate at the time of the transaction.
3. How long does the process take?
Usually, once a valid file is submitted, the SI agency resolves it within 10-15 working days. However, the preparation time (especially for POA from abroad) can take 2-4 weeks.
4. Why should I choose DEDICA over informal services?
DEDICA is a legal entity managed by the Ho Chi Minh City Department of Justice. We are legally responsible for our advice and actions. With a team of lawyers who have worked for multinational corporations, we understand the mindset and expectations of international clients.
