“I am an American who previously worked in Vietnam and participated in mandatory social insurance. I have now quit my job and am preparing to return home. Can I withdraw my social insurance benefits myself, or do I have to go through my former company?”

This is a fairly common question for many foreign workers after their employment in Vietnam ends, especially in cases where the former company no longer provides support, the responsible personnel have left, or the worker needs to process documents urgently before departure. According to regulations on mandatory social insurance for foreign workers, eligible workers can, in principle, directly handle the procedures with the social insurance agency without being required to go through their former company.

However, in reality, whether or not one can do it themselves depends heavily on the status of each individual's social insurance records.

For example, if the previous company has completed the labor reduction procedures, finalized the social insurance records, and the social insurance participation data has been accurately updated in the system, the processing is usually much smoother.

Conversely, in many cases, workers only discover when they are about to withdraw their social insurance benefits that the company hasn't finalized their records, their passport information isn't synchronized, they lack employment records, or they have multiple social insurance numbers due to working at several companies. Furthermore, many foreign workers leave Vietnam quickly after leaving their jobs, leaving little time to directly work with the social insurance agency or supplement their records if issues arise.

In other cases, they only begin processing their social insurance benefits after returning to their home country, so further consideration is needed, such as authorization or assistance with paperwork from Vietnam. In reality, many workers believe that they can immediately withdraw their social insurance benefits after leaving their job. However, the conditions for receiving a lump-sum social insurance payment for foreigners depend on each specific case according to current regulations, including residency status, employment records, and previous social insurance participation data.

This is why foreign workers should check the status of their social insurance records as soon as possible before leaving Vietnam to avoid any problems when dealing with financial benefits later.
